A judge delayed the sentencing for Michael Flynn, President Trump’s former national security adviser who pleaded guilty to lying to the FBI about his interactions with the Russian ambassador to the U.S. Flynn arrived for his sentencing hearing in Washington D.C. on Tuesday, where Judge Emmet Sullivan announced his decision to delay sentencing shortly before 1 p.m.

Syllivan did not hold back when addressing Flynn and his actions, telling him at one point that “arguably you sold your country out,” according to reports from inside the courtroom. Flynn’s lawyers requested the delay during the hearing where Judge Sullivan blasted Flynn, saying he could not hide his disgust and disdain.

Sullivan’s harsh words raised the prospect that he could send Flynn to prison — an unexpected development since prosecutors have recommended against prison time, citing his cooperation in special counsel Robert Mueller’s Russia probe. The delay allows Flynn to continue cooperating with the Russia probe and get credit for it in his punishment.

In a sentencing memo on Dec. 4, Mueller had said Flynn should be shown leniency and not be given any jail time because of his cooperation in the probe and his military and public service. A heavily redacted addendum was also attached to the memo detailing Flynn’s cooperation.

Earlier this month, Michael Cohen, Trump’s former personal attorney and “fixer,” was sentenced to three years in prison for tax fraud and hush money payments to silence women who say they had affairs with Trump. Prosecutors in New York say Cohen’s payments to the women were made at the direction of “Individual 1,” which refers to then candidate Trump.
